Oliver Enterprises, Inc. dba Bill Oliver Horsemanship (“Oliver Enterprises”) created and maintains the information, education and training in horsemanship offered via non downloadable video courses on this website  www.billoliver.thinkific.com, which is Oliver Enterprises website for  Online Education and Training (the “OET Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following Terms of Use.   These Terms of Use for are intended only for and are specific to Oliver Enterprises training   and education services available online via the OET Site only.  These Terms do NOT apply to any live education and training provided by Oliver Enterprises, and do not apply to the  www.billoliverhorsemanship.com  website in general, which operates under its own Terms of Use.   Additionally, the OET Site is hosted by Thinkific Labs Inc. (“Thinkific”). Thinkific’s Terms of Service are available at https://www.thinkific.com/resources/terms-of-service/.  

Please read the terms carefully before using the OET Site.  Use of this OET Site indicates acceptance of these “Terms of Use” and forms a binding agreement between you, the “User” and Oliver Enterprises. If you do not agree to these terms, do not use this OET Site. 

These Terms of Use are intended to cover any and all access, navigation, or use of the OET Site. Oliver Enterprises may establish additional conditions beyond those covered by these Terms of Use to regulate using, reserving, and/or contracting specific products or services offered to the User through the OET Site. If the User currently has in effect a separate written agreement with Oliver Enterprises for a product or service related to live, onsite training and education, that agreement shall govern that use, and these Terms shall govern use of this OET Site and use of the products and services available only through the OET Site. 

Users may be required to register with the OET Site and provide certain personal information such as name and email address to access certain content on the OET Site. Oliver Enterprises will use this information in accordance with the terms of the Privacy Policy posted on the OET Site.

1. General Limitations on Use

The User will use the OET Site and its contents and products or services in accordance with the law and these Terms of Use.   Any use of the OET Site or and any content thereon other than for User’s personal use and edification, or as otherwise specifically authorized herein, is prohibited.    The User’s access to and browsing of the OET Site shall not be considered or construed as a waiver, transmission, license, or total or partial transfer of these rights by Oliver Enterprises or its licensees.

2. Intellectual Property 

Oliver Enterprises provides a variety of education, information, training, and other information via the OET Site through a variety of media (the “OET Content”), which along with the OET Site, are protected by copyright, trademark, right of publicity, and other intellectual property laws.  Any trademarks, service marks, and/or trade dress on the OET Site, including the Oliver Enterprises trade names, trademarks, and logos, are owned by Oliver Enterprises and/or its licensors, or that are owned by third parties, are protected by United States and worldwide trademark laws. The works of authorship on this OET Site, including but not limited to all video recordings, audio recordings, photographs, written materials, designs, texts, and images, are owned by Oliver Enterprises and/or its licensors, or by third parties, and are protected by United States and worldwide copyright laws.

3. Prohibited Uses

Except for use as personal edification, User shall not copy, modify, use, or distribute any non-video and non-audio OET Content such as text, photos, designs, graphs, or any portion thereof, in any way without the prior express consent of Oliver Enterprises, or circulate to anyone, including others in the same company or organization, without the express permission of Oliver Enterprises except that the User may disseminate an insubstantial portion of non-audio/non-video content for a noncommercial purpose, in non-electronic form, to a limited number of persons, provided all copyright and other proprietary rights notices are included with such portion of the content in the same form in which the notice appears on the screen/material.

In accordance with these Terms of Service, except as permitted herein, the User may NOT:

Any breach of this Section 3 of the OET Site Terms of Use automatically terminates User’s authorized use of the OET Site and OET Content.

4. User Warranty

By accessing and using this OET Site, User warrants that they are not an agent or employee of any other entity or party that provides or wishes to provide competing products or services, and User warrants their use of the OET Site and OET Content are solely for personal use and edification not for any commercial purpose.   [YOU DO NOT NEED TO INCLUDE THIS IF YOU DO NOT THINK IT IS NECESSARY]

5. Hyperlinks

Links to external websites are provided solely as a convenience to you. Oliver Enterprises has not reviewed all these external websites, does not control and is not responsible for any of these websites or their content. If a User decides to access any of the external websites linked to this OET Site, the User does so entirely at their own risk.

The OET Content is provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Oliver Enterprises further does not warrant the accuracy and completeness of the OET Content at this OET Site. Oliver Enterprises may make changes to the OET Content at this OET Site, or to the services and prices described in them, at any time without notice. The OET Content at this OET Site may be out of date, and Oliver Enterprises makes no commitment to update OEP Content on this OET Site.

‍7. Limitation of Liability

By using and accessing the OET Site and the goods and services available through the OET Site, User understands and acknowledged that Oliver Enterprises is not responsible in any way for any loss that results from or arises out of the use of the factual information on the OET Site; the unavailability, performance, or security vulnerabilities of the OET Site; the actions of any third party (including a third party that violates the security systems of the OET Site); or that otherwise results from or arises out of User’s access to, or use of, the OET Site or the operation of the OET Site or the failure of the OET Site to operate, including but not limited to any lost profits or direct, indirect, special, consequential, compensatory, or incidental damage, even if Oliver Enterprises has been previously advised of the possibility of such damages, whether in an action in contract, negligence, or any other theory, arising out of or in connection with the use, inability to use or performance of the information, services, products, and materials available from the OET Site. 

These limitations apply notwithstanding any failure of the essential purpose of any limited remedy. The acceptance of this limitation of liability is an essential term of the agreement between you, the User, and Oliver Enterprises, and the User acknowledges that Oliver Enterprises would not grant access to the OET Site without the User’s agreement to this term.   

The User’s sole and exclusive remedy for any claims against or dispute with Oliver Enterprises in connection with use of the OET Site and OET Content is to discontinue use of the OET Site and OET Content.

8. Release of Liability for Equine and Livestock Activity

Oliver Enterprises provides information and education and training related to creating equine intelligent riders who better understand horse behavior and communication necessary to create a develop the trusted rider and horse relationship that embodies Bill Oliver Horsemanship and which necessitates the User work with a horse/horses.   By using the OET Site and viewing OET Content, User acknowledges that they are aware of and appreciate the dangers, hazards, unpredictable nature and inherent risk in horse and livestock related activities and that such risks include personal injury, death or damage to property, and all other risks connected therewith, whether foreseen or unforeseen, known or unknown. By accessing the OET Site, the User expressly agrees to indemnify, fully and forever release, discharge, defend, and hold harmless Oliver Enterprises from any and all liability, claims, damages, loss, injury, or death which the User might sustain from any livestock or horse related activities, whether or not related to the OET Site and OET Content. This release includes and binds the User and the Users heirs, successors, assigned executors, administrators, and personal representatives. 

Oliver Enterprises recommends that all Users have experience with equines and equine training before attempting any of the activities described in the courses or in any other content on the OET Site. Notwithstanding this recommendation, the User understands that they accept all risks in connection with participating in any and all horse or livestock related activities, and voluntarily assumes all direct, indirect, and inherent risks and liability associated with such activities.

9. Applicable Law

The Terms of Use are governed by the laws of the state of Wyoming, United States. Failure to enforce strict performance of the Terms of Use shall not be construed as a waiver of any provision or right. Oliver Enterprises may assign its rights and duties under the Terms of Use without notice to any party at any time.

The Terms of Use are effective as of March 20, 2024 and are subject to change without notice by Oliver Enterprises at any time in its discretion. Please check for changes regularly.  Use use of this OET Site after such changes constitutes agreement to such changes.
